Rules of Medical Practice According to Islamic Jurisprudence

God, Almighty, has prescribed the learning as well as the practice of Medicine. He relieved medical practitioners from any responsibility, since they merely fulfil their duty, if certain conditions are satisfied. In so far the treatment of the body is concerned, the conditions for relieving the practitioner of the responsibility resulting from any damage, are the patients consent , the intent of treatment, following the acceptable rules of practice and giving the normal care expected from his peers. Even in the event of possible responsibility on the part of the practitioner, some scholars argue that such responsibility should be shared by his family, the medical profession at large , and as a last resort the State itself. As to post mortem examination of the body, i.e., autopsy, it is legitimized under Moslem Law, if prior permission by the person or his family is obtained. The justification of such license lies in the fact that the interest of the living surpassed that of the sanctity of the dead.
