In Islamic Jurisprudence

‘Figh’

By: Ajeel Annashml

Faculty of Shari’a

Kuwait University

‘Figh’ assigns a vital and an important position to currency because Man’s life depends on it in obtaining his necessities, satisfying his needs and fulfilling his expectations. Dealing in money has many outcomes which range from the prohibited ‘Haram’ to the permissible ‘Halal’ and is accompanied with certain conditions and controls. Because of the variation of currency, the changes that have occurred on money throughout the ages, and the rights and duties which result from dealing in money, this paper handles currency or money.

The researcher begins by defining money, retelling its development through the ages and enumerating the types of money and the development of each type.

The paper discuss the causes which led to interest on money and ‘jurists’ opinions on interest on money. It also discusses the views of different creeds regarding the ‘Zakah’ paid on money.

The paper concludes by telling the story of the development of paper money till it has replaced gold and silver coins.

In reply to those who say that ‘Zakah’ does not apply to paper money, the researcher compares paper money with coins and reaches the conclusion that ‘Zakah’ applies to paper money since it has replaced silver and gold which from coins were made and because paper money has become the most internationally used currency.
