Guardianship in the Contraction of Marriage

By : Juma Muhammad Barra

Social relationships, which are based on the mutual respect, taking care of others’ welfare and proprieties, have been strongly emphasized in Islamic law both in the Holy Qur’an and the Prophet’s (p.b.u.h.) traditions. This sort of relationship is more emphasized among the family and tribe members in particular since the family is the basis of the Islamic edifice. This topic, as pointed out by the Islamic law, was tackled by Muslim jurisprudents who tried to resolve the ambiguity of certain texts and produced their independent judgment in the theological questions based on the interpretation and application of the four main sources (Usu’l), thus enriching the Islamic jurisprudence with laws covering all aspects of our life.

Martial life which is based on mercy, love and cooperation has been particularly highlighted in Islam. In order to lead a peaceful and harmonious life, there should be a mutual agreement of both parties concerned. The girl is normally proposed to through her next to kins who do their best to see her happy with her husband. The topic is dealt with thoroughly by the present researcher.

(I only seek Allah’s guidance and assistance)
