The legitimacy of estimation of theMaalikis, between the suspected and the decisive

The legitimacy of estimation in the Qur’an and Sunnah and sayings of scholars are not on the same degree. Many of the scholars may not distinguish between what is absolute and can not be changed, nor can it be agreed upon, as in matters of inheritance fixed by the decisivetexts and the consensus of the nation. The researcher followed the words of the Maalikis in relation to the legitimateestimations, and the scholars of the Maalikis, then address the questions that show arranged and degrees of these estimations in terms of deterministic and suspected, and based on that of the scientific and practical impact on the legality of diligence in the abilities or lack thereof.
This study came in three sections:
The first topic: the definition of estimations, and arranged in the charge of the person
The second topic: Definition of suspicious and decisive in language and terminology
The third topic: Ruling on ijtihad in the legitimate capacities
Under these three investigations, the study concluded with a brief conclusion that includes the most important results, and God succeed
