Conditional Divorce In Islamic Legislation and Personal Status Law Dr. Saleh Al-Ali Assistant Professor of Comparative Jurisprudence and Legislative Policy Sharia and Islamic Studies – Kuwait University Abstract: The research aims to show what the man should do if he conditionally divorce, whither the condition has done or not, and whether the talker meant to obligate the talkee to do something of to not. The Sheikhs’ opinions in the doctrines are three; The First: the divorce is done when the condition done, The Second: the divorce is not done, whether the condition done or not, The Third: left it to the intention of the man. Then, the researcher showed the Kuwaiti legislator in the Personal Status Law to the Kuwaiti courts that cancelled the conditional divorce by explanatory note of the Article (105). The researcher used descriptive analytical method to reach the total conclusion of the research that concluded the multi-opinions of Sheikhs about this topic.
