Absolute Interest: Study in the emergence of the Term and its Development Dr. NaumanJagheem Co-Professor, Faculty of Sharia and Law, Sultan Sharif Ali Islamic University, Brunei Abstract The subject of Absolute interest is one of the subjects which had many contemporary studies, moreover it is written the fundamental books of jurisprudence which followed “Al-Juwaini-Al-Ghazalli” fundamental school, in the past and present. Despite what was written about the absolute interests, but the historical aspect of this term, despite its significance, did not have sufficient research. This research aims to study the emergence of the term of “Absolute Interest” and its development. This is in order to show the historical context for its emergence and its position in the fundamental thinking, identify the turmoil resulting from its accreditation to schools of scholars. The methodology of this research based on tracing the discussion about the absolute interest in the Reference Books of the fundamentalist ancestors, seeking to identify the era in which this term was introduced and its development. Also, expressing and analyzing what is written by Al-Juwaini and Al-Ghazalli, because these writings represent the core subject for this matter. The most significant outcomes of this research are: the term “Absolute Interest” emerged and developed in the fundamental school of Al-Juwainiand Al-Ghazalli (spreader after Al-Ghazalli at the fundamentalists who are affected by this school) There is no existence for the term of absolute interest and what ever related to it in the fundamentals of Maliki Doctrine until the age of Ibn Arabi. The term absolute interest was used by the Maliki scholars who are affected by the fundamental school of Al-Juwaini and Al-Ghazalli. The most significant reason for the turmoil resulted from accrediting the opinion of the absolute interests to the Imams of the Juristic Doctrines is the result of the projection of the concepts made by the later scholars over the diligence of the ancestors and the negative effect of the examples accredited to Malik by Al-Juwaini and the examples which through it Al-Ghazalli discussed the absolute interest.
