Financing the Deficit in the Public Budget via the Public Loan Juristic Fundamentalist Study Dr. NajmElddinQader Al-Zanki Co-Professor and Assistant Dean, Faculty of Sharia & Islamic Studies, University of Sharjah – United Arab Emirates Abstract: This study aims to investigate the public loan and what it could contribute from the Islamic economic prospective in financing the deficit in the public budget of the State. Using the analytical deductive approach. Which known as the deficit status and its causes, the public loan and collection methods, then conclude the controls and make balances, combined with the juristic fundamentalist analysis. The study reached juristic and fundamental outcomes, the most significant of it are: Islamic jurisprudence allow seeking public loans, even if compulsory, provided that there is an expected revenue for the State in which it can repay the loan. The State should not get loans, which it could not repay in the future, because this would make burden for the coming generations and contradict the social justice which should be exist among the various generations. The loans of the State should be within the expected revenues. The study also showed that reclamation has a significant position in the juristic roots for public finance issues. Such resource has application flexibility, made it the preferred evidence compared to the partial analogy in the process.
