Methods to Identify Objectives of the Sharia BetweenAl-Shatibi and the Contemporary Scholars Prof. NaamanJagheem (*) Abstract: Al-Shatibi mentioned at the conclusion of the section related to the objectives at his book “Al-Mowafaqat” four attitudes which through it, he defined the intentions of The Legislator not what is ascribed to Him. Mohamed Al-Tahar Ben Ashourmentioned three methods to reach a verification for sharia objectives, which are different from what is mentioned by Al-Shatibi. Some contemporary scholars mentioned paradox to some of these attitudes, they also are uncertain of the conflict betweenAl-Shatibi and Ben Ashour. These paradoxes refelected on the methods formed by some of the contemporary scholars to identify sharia objectives. Based on the division of objectives in to sharia speech and sharia rules objectives. The methodology of the research is based on what is mentioned by Al-Shatibi and what is mentioned by the contemporary scholars. Analyze and discuss such paradoxes then what is mentioned by Ben Ashour and what is mentioned by the contemporary scholars regarding his paradoxes, with analysis and criticism. Then mentioned the most significant methods mentioned by the contemporary scholars with analysis and criticism. In the conclusion I have presented a new formation for the methods identifying the objectives. The research concluded by the integrity of what is mentioned by Al-Shatibi and Ben Ashour and non-conflict between them, despite being different. The cause of this difference is attributed to the different objectives to be identified. The research conduced that; the criticism for the methods mentioned by Al-Shatibiis attributed to the non-understanding of his intention. The prevailing ambiguity at the contemporary wrtingsis attributed to the lack of understanding between objectives of the sharia speech and objectives of sharia rules, and not realizing that each has its methods which it is being identified by.
