Abstract:
This research discusses the issue of the gradual application of the Sharia as a necessity in the desired reform. The research shows the concept of the Islamic Sharia and the role of its application, and the fruits of that application, and the barriers to full application of the Islamic Sharia. The research also shows the meaning of the gradation in the application, its justifications, and its rules, so that the gradation does not mean to escape from the application of the Sharia or circumvention on the main purpose for which it was the graduation. The research concluded that access to the full application of Islamic law is impossible in many Arab and Islamic countries because there are a lot of barriers to that application. This makes the gradation in the application is a necessity and a religious legitimate duty, as the legitimate Islamic rule says: "What the duty cannot be complete without it, is a duty".
