This research offersa law Fiqh detailed study to the subject of dispersion of married couples because insolvency in paying dowry to the wife. This issue is based on exposition of opinions of Fiqh 4 schools as a basis and comparing them with Jordanian personal law and decisions of the court of appeals of shari'ah in Hashimite kingdom of Jordan which clarified what was mentioned in law concerning this issue. It treated issues the law did not mention. The research dealt with dowry issue and reason of payment and time of its reception and demand of it. The right of wife to demand dowry through court and what results of its demand of the insolvent husband in paying it, and the possibility of demand of dispersion and the time of demand before or after getting married.
The research shows the way of dispersion which is done after or before insolvency of the husband and giving a certain time to be able to pay dowry for his wife and what can prevent demand or continuing of plea as when dowry is cashed or some of it or previous knowledge of wife of husband's insolvency and accepting it.
At last I mentioned the kind of dispersion which comes as a result of insolvency in paying dowry or half of it and of obligation of waiting period after divorce. (Idda)
