Espionage and its effects an Islamic Fiqh as well as on contemporary Security legislations

1 – Espionage in language is seeking and examining the depth of matters . From Shari'ah perspective is following your fellows' defects and shortcomings to discover his secrets .It is often used in evil doing .
2 – The Holy Qur'an and The Sunnah dispraise espionage . It is considered a big sin . It is never used as a good deed except in search for religion .
3 – Reasons for espionage are various . They are sometimes dispraised and may also be praised as we showed in our study .
4 – Fiqh description of espionage profession on other persons is sometimes a duty that should be done in case of espionage on infidels or on those who do misdeeds but in other times it is prohibited in case of being practiced on straight forward and enlightened people in some other times it can be bad or good according to circumstances or in  case of suspicion .
5 – Means of espionage are various like using tiny cameras and using very small listening machines  , telephones , computers and secret invisible ink .
6 – Security men should be of good behavior to succeed in this profession . They should be permitted by the head of the state and they should be efficient in this profession with a lot of experience and expertise besides being honest , strong and broad – minded .
7 – Scientists have different opinions on the punishment of spies following his purpose and his identity . If he were an infidel he must be killed as it is unanimously agreed on . If he were non-muslim living among muslims , he is also killed . If he were a muslim , he is killed according to general good for society and may not be killed if the head of the state decides .
8 –Doing espionage may benefit society in realizing security ,  justice for individuals and community , be ready to face danger and keep the state systems , its discipline , capacities and regulation safe and sound .
