This research aims at showing the concept of difference and defining its terms according to fiqh scholars and distinguishing its relation with revealed judgments between natural will and shari`ah will for Allah (Subhanahu wa Ta`ala) and defining the nature of difference that is considered in real life situations with showing its validity for considering it a weak point to take for Shari`ah judgments or a good description for reasoning and clarifying conditions where it should be applied.

 

The researcher applied the inductive method to realize this objective, honoring the Shari`ah intention of difference while following the method of fundamentalists in this subject, observing issues and examining evidences to be sure of the extent of consideration in judgment issues.

 

Then  the researcher starts analyzing the inducted material to see Shari`ah intentions and fundamentalist controls observed. The researcher concluded that the legislator did not intend to determine as a considered description either in evidences or in judgment. In this context he dealt with some similarities which are exposed to this establishing of the origin as legislator determined the most weighed opinion as a way for consideration of judgments.
