The research is supported by research administration University of Kuwait (No HJ 10/08).

 Marital life is not always smooth and happy. Problems may occur and have bad impact on all family members  including children. Scholars agreed that in case that parents separate for some reasons and having a son or daughter the mother has the right to foster the child unless there is a reason  preventing her from fostering the child or unless the child has something to prevent him the right of choice. Islamic legislations guaranteed happy life for family members. Children after their natural period of fostering terminates, they have the right to choose who has the right of fostering. Then and even if they wanted to change a parents fostering any time they like. The researcher showed rules of sponsorship and right of nursing and those who have the right to nurse and conditions of nurse providjng  and termination of nursing period.The researcher mentioned opinions of scholars of giving the child the right of choice mentioning their evidences, discussing them and weighing them and comparing with Kuwaiti Personal Law.
