Bribery in Companies - Theory and Practice: A Comparative Study Between Kuwait and the UK.

Goal of The Study: This study aims to describe, diagnose and analyze the subject of bribery in the companies and the private sectors with its various aspects and dimensions. The topic of bribery, in private sector in general and in companies in particular, stirs interesting legal issues that worth being studied in order to find suitable solutions and replenish any legal gab in that regard.
Study Methodology: The article followed the process of a comparative legal analysis which overall helps researchers to view other countries' laws, compare and analyze them to benefit from their experience and experiments.
Study Sample: In order to tackle and analyze bribery in the private sector and companies though research, the legal situation in Kuwait had to be tackled in comparison to the one enforced in the UK.
Study Results: The research came up with number of outcomes among which is that, according to Kuwait law, the crime of bribery is correlated with public sector employees, does not include private sector employees but in very narrow limits, combating and minimizing bribery need new ways, and that Kuwait Anti-Corruption Authority (Nazaha) can play an effective role in limiting and combating the crime of bribery.
Study Conclusion: The research was concluded with a number of recommendations the most important of which are:
Criminalizing the act of bribery in the private sector.Greater use of technological advances should be made particularly in the research, investigation and evidence gathering stages.Granting the Kuwait Anticorruption Authority (Nazaha) effective role in the judicial seizure and collecting evidences stages.
