FEDERAL EXECUTIVE POWER IN UAE HINDRANCES AND SOLUTIONS

The United Arab Emirates (UAE) got its independence on December 2nd 1971. It is a federal of seven emirates: Abu Dhaby, Dubayy (Dubai), Aash Shariqah (Sharjah), Ra’s al Khaymah, Umm Al-Qaywayn, Ajman and Al Fujayrah. The UAE provisional constitution divided the general federal powers to five bodies which practice the legislative, executive and judicial powers. This means that the one job is practiced via several bodies. According to the UAE provisional constitution the federal powers are composed of the federal supreme council of rulers, the federal president, the federal council of ministers, the federal national council and the federal court.

This study highlights the role of the federal executive power in the UAE which is composed of the Federal Supreme Council of Rulers, the Federal President and the Federal Council of Ministers. This study includes an introduction, followed by six parts and finally a conclusion.

Part 1:

Indicates the power of the Federal Supreme Council of Rulers, its formation, its meetings and how it takes decisions. The functions of the Federal Supreme Council are divided into three (3) parts:

  • Functions practiced by the Federal Supreme Council alone.

  • Functions the Federal Supreme Council of Rulers practices via the President.

  • Functions are practiced via the Federal Council of Ministers.

These functions indicate that the Federal Supreme Council of Rulers is the highest legislative and executive power in the UAE.

Part 2:

Highlights the power of the Federal President and his Vice President, the Prime Minister; how they established their positions and the executive functions of the president. These functions have three phases:

    1. functions the President practices personally;
    2. functions the President practices in cooperation with the Federal Supreme Council of Rulers, and
    3. Other functions the President practices in cooperation with the Federal Supreme Council of Rulers and other functions the President practices in cooperation with the Council of Ministers.

The study indicates that the individual powers of the President are weak and scanty; his practices are supervised by the Supreme Council of Rulers of the Federal Council of Ministers.

Part 3:

Discusses the functions of the Federal Council of Ministers; how the Prime Minister is selected, his functions, how ministers are appointed, their responsibilities and duties and the administrative, the executive and the functions of the Federal Council of Ministers.

Part 4:

Demonstrates observations, explanations and analytical studies on the five ministries formed in the UAE since its foundation, the number of ministers and the distribution of ministries among the Emirates members of the federation.

Part 5:

Debated with the hindrances that face the federal executive power in the UAE, i.e. the hindrances that face the Federal Supreme Council of Rulers, the Federal President and the Federal Council of Ministers. The most important hindrances are the weaknesses of the federal executive agencies in carrying out their executive role since every emirate sticks to its autonomous independence and halts any interference in its domestic affairs.

Part 6:

This part presents some solutions and suggestions which can contribute in increasing the competency and efficiency of the federal executive agency in order to overcome the difficulties and problems the agency faces. These solutions are related to the Federal Supreme Council of Rulers, the Federal President and the Federal Council of Ministers.

We believe that some of these solutions and suggestions can be implemented in the present conditions and the other could be carried out in case the provisional constitution of the UAE is amended or a new constitution is written for the federal state putting into consideration the developments that took place in the UAE since its independence.
