EMPLOYER’S RIGHTS: NATURE AND TYPES A COMPARATIVE STUDY IN KUWAIT AND GCC LAWS

         This study deals with ‘employers power’ and his need for the state’s legal and financial support in light of Kuwaiti and GCC Laws.

         The study is divided into three parts:

 Part 1:

         Deals with the employer’s right to regulate work conditions, running his firm, the role of each work as well as the employer’s power to change work conditions according to the stimulations of the contract.  This part ends by concentrating on the legal guarantees vis-à-vis cases of changes in working conditions.

 Part 2:

         Deals with ‘disciplinary measures’ that employer can administer their legal nature; sanctions and their conditions.

 Part 3:

         Deals with other rights in the power of the employer such as shutting down the firm as changing its activities, the allegiance of the workers to his firm, keeping the secrets of the job and not to compete with its enterprise, in addition to his legal rights and state support that enhances social and economic activities of establishments.

         The conclusion shows the need for legal and state support that is necessary for the development of national Gulf and Arab Corporations.
