THE INTERNATIONAL RESPONSIBILITY OF IRAQ FOR ENVIRONMENTAL DESTRUCTION

        This paper is divided into three parts: The first part deals with aspects of the environmental destruction:

 A.    Sea and Land Destruction:

         One of the gravest results of the Iraqi invasion of Kuwait was the occurrence of the worst catastrophe in contemporary history, i.e. the oil spill that has led to the pollution of the coasts of the eight states on the Gulf and has also endangered the marine life in the area.  The land environment similarly suffered as the result of the heavy equipment armored cars, tanks and transportation vehicles that destroyed the infrastructure in Kuwait, in addition to the burning of hundreds of the oil wells that caused the pollution of wide land areas in Kuwait.

 B.   Atmospheric Pollution:

        The smoke resulting from the burning oil wells emitted toxic carbon monoxide, dioxide and other dangerous gases that are detrimental to life.  The second part deals with the international environmental declarations and agreements, which behave all states to preserve the environment and safeguard its protection against pollution and destruction.   This part also shows the implication of the Geneva War Convention for the environmental destruction inflicted by Iraq on the natural wealth and the environment of Kuwait and how these flagrant acts are prohibited by the stipulations of those conventions.

         The third part deals with the United National Security Council resolutions especially Nos. 674, 686 and 687 (of clause No. 16).  This shows that international laws and resolutions hold Iraq accountable for environmental destruction in Kuwait and is responsible for compensating the Gulf States for the damage inflicted on them.
